SUPERIORITY OF JUSTICE NOT LAW

In the Indo-Pak subcontinent where the British left much desolation the system of law given by them has become a cancer for the society, it is constantly oozing out injustice and tyranny. Under this system superiority rests with the law, no matter how cruel and unjust it is. If justice is stomped under the feet of this system, the whole system will not bother, because this system is not made for the superiority of the justice but was made for the superiority of the law. A sincere, honest and a capable judge becomes powerless that his hands tremble when writing down a sentence. The books of law are filled with examples where innocent were hanged and the decision giver judges could never repent their injustice as their verdicts were according to the rule of law.

Now let us look into a case where a person on his way to somewhere is murdered. The place is uninhabited like a farm field. The murdered is a member of an influential family which has a feud with a normal household. The SHO of a police station, which is a rank amongst which finding an honest person is like finding a black ant on a black rock in a black night. The SHO for the sake of greed, nepotism or a posting produces a report that has witnesses present on the scene of the crime. Then a pistol similar to the one used in the crime is brought and bullets fired from it are buried in the ground and are eventually found around the body of the murdered. Then using a strong lawyer an innocent is proven guilty such that no one is able to challenge this in Supreme Court. We can find thousands of such people rotting in jails and getting hanged. One person has committed the murder and ten are registered in the report, the dishonest policemen and false witnesses are used to convict innocent people to avenge one's enmity. The business of lawyers runs around fabricating a false story as opposed to the true one. This story can prove an innocent as the murderer and the murderer as an innocent. One can be arrested on the charges of hooliganism or on the charges of a robbery and sent to jail. The rule of law and the justice of system is unable to retrieve your honour. Fake witnesses, dishonest investigative officers swearing under oath bearing Allah as their witness and corrupt lawyers with their confusing law jargon are plentifully decorated. This is the system where the whole city is bearing witness to someone's dishonesty and fraud, on the contrary the courts proceedings are executed in the opposite direction. It is often that the judge is fully aware of the fact that the offender before him is extremely corrupt. People known to him have bribed him for a certain act, but the proceedings that are presented to him by the investigative officer is sufficient to prove him innocent and helplessly the judge signs the warrant that sets him free. In this whole system the court's responsibility is not to impart justice but to ensure punishment to those who have acted against the law. Without any doubt this law has been by those sitting in the assembly to oppress the people. It is astonishing that you will find that under the law SHO has the authority to arrest an innocent man on the basis of a suspicion and disgrace him. The courts can bail him or terminate the case. A policeman can arrest a person, keep him in a private place and torture him then one day after submitting his arrest receive a remand, the past days of persecution are out of the jurisdiction of the court. A vandal, thug an influential person has made miserable the life of the people, an FIR can not be registered against him nor a complaint is heard against him on the political level. All judges of the court are helpless against such a person. This is the system of the law that has given birth to a generation of dishonest, vicious murderers and extortioners, who blatantly say that go to the court instead of blaming them. The whole city is aware of their cruelty, the whole country is aware of the stories of their corruption but they speak unashamedly in front of the nation. There is not a single case proved against them in the court. All these cases are political. In this law given by the British the worst is the authority to accept an appeal of pity. In the whole system if someone is indicted up to the level of the Supreme Court, still the President has the authority to set him free. This is the authority on which Rasul Allah (May peace be upon him) said "After a crime has been proved, even I do not have the right to pardon". This is the reason why many convicts who have been sentenced to death are roaming free and are leading a life of ease after appealing for pity to the President. More than 400 are in Punjab alone. Amongst them are ethnic and sectarian terrorists. In the past three years there is hardly a case where the sentence to death has been executed.

As opposed to this law of the British my Allah does not limit a judge to confines of his courtroom. The judge has the authority to carry out the investigation himself, so that he can impart justice. According to this golden rule of Islam, France has constituted her judicial system. A judge who is hearing the case and an investigative judge have their responsibilities. And the investigative judge after investigating the case at once takes the responsibility of the judge hearing the case. In this way if the judge thinks that the police is maliciously involved, witnesses have been compromised or the file has been emptied due to a political reconciliation, he can investigate himself and make justice essential. This is the reason that France has the least number of crimes amongst the European countries. After the slavery of the hundred years this nation been gifted many things. But the worst amongst them is this Anglo Saxon Law in which the powerful, influential and the one with authority after committing an atrocity, comes out of the court in garlands and the innocent but the weak and helpless sheds his tears in the loneliness of his prison.

مال تمہاری ملکیت مگر وسائل معاشرے کی ملکیت ہوا کرتے ہیں

جرمنی ایک صنعتی ملک ہے جہاں دُنیا کی بہترین مصنوعات اور بڑے بڑے برانڈز مثلاً مرسیڈیز بینز، بی ایم ڈبلیو اور سیمنز پروڈکٹس بنتے ہیں۔ ایٹمی ری ایکٹر میں استعمال ہونے والے پمپ تو محض اس ملک کے ایک چھوٹے سے گاؤ

ں میں بنتے ہیں۔ اس طرح کے ترقی یافتہ ملک کے بارے میں کوئی بھی سوچ سکتا ہے کہ وہاں لوگ کس طرح عیش و عشرت کی زندگی گزارتے ہونگے، کم از کم میرا خیال تو اُس وقت یہی تھا جب میں پہلی بار اپنی تعلیم کے سلسلے میں سعودیہ سے جرمنی جا رہا تھا۔

میں جس وقت ہمبرگ پہنچا تو وہاں پہلے سے موجود میرے دوست میرے استقبال کیلئے ایک ریسٹورنٹ میں دعوت کا پروگرام بنا چکے تھے۔ جس وقت ہم ریسٹورنٹ میں داخل ہوئے اس وقت وہاں گاہک نا ہونے کے برابر اور اکثر میزیں خالی نظر آ رہی تھیں۔ ہمیں جو میز دی گئی اس کے اطراف میں ایک میز پر نوجوان میاں بیوی کھانا کھانے میں مشغول تھے ، اُن کے سامنے صرف ایک ڈش میں کھانا رکھا ہوا تھا جس کو وہ اپنی اپنی پلیٹ میں ڈال کر کھا رہے اور شاید دونوں کے سامنے ایک ایک گلاس جوس بھی رکھا ہوا نظر آ رہا تھا جس سے میں نے یہی اندازہ لگایا کہ بیچاروں کا رومانوی ماحول میں بیٹھ کر کھانا کھانے کوتو دل چاہ رہا ہوگا مگر جیب زیادہ اجازت نا دیتی ہو گی۔ ریسٹورنٹ میں ان کے علاوہ کچھ عمر رسیدہ خواتین نظر آ رہی تھیں۔

ہم سب کی بھوک اپنے عروج پر تھی اور اسی بھوک کا حساب لگاتے ہوئے میرے دوستوں نے کھانے کا فراخدلی سے آرڈر لکھوایا۔ ریسٹورنٹ میں گاہکوں کے نا ہونے کی وجہ سے ہمارا کھانے لگنے میں زیادہ وقت نا لگا اور ہم نے بھی کھانے میں خیر سے کوئی خاص دیر نا لگائی۔

پیسے ادا کر کے جب ہم جانے کیلئے اُٹھے تو ہماری پلیٹوں میں کم از کم ایک تہائی کھانا ابھی بھی بچا ہوا تھا۔ باہر جانے کیلئے دروازے کی طرف بڑھتے ہوئے ریسٹورنٹ میں موجود اُن بڑھیاؤں نے ہمیں آوازیں دینا شروع کر دیں۔ ہم نے مڑ کر دیکھا تو وہ ساری اپنی جگہ کھڑی ہو کر زور زور سے باتیں کر رہی تھیں اور ہم نے یہی اندازہ لگایا کہ اُنکا موضوع ہمارا ضرورت سے زیادہ کھانا طلب کرنا اور اس طرح بچا کر ضائع کرتے ہوئے جانا تھا۔ میرے دوست نے جواباً اُنہیں کہا کہ ہم نے جو کچھ آرڈر کیا تھا اُس کے پیسے ادا کر دیئے ہیں اور تمہاری اس پریشانی اور ایسے معاملے میں جس کا تم سے کوئی تعلق ہی نہیں بنتا میں دخل اندازی کرنا ہماری سمجھ سے باہر ہے۔ ایک عورت یہ بات سُنتے ہی ٹیلیفون کی طرف لپکی اور کسی کو فوراً وہاں آنے کو کہا۔ ایسی صورتحال میں ہمارا وہاں سے جانا یا کھسک جانا ہمارے لیئے مزید مسائل کھڑے کر سکتا تھا اس لئے ہم وہیں ٹھہرے رہے۔

کچھ ہی دیر میں وہاں ایک باوردی شخص آیا جس نے اپنا تعارف ہمیں سوشل سیکیوریٹی محکمہ کے ایک افسر کی حیثیت سے کرایا۔ صورتحال کو دیکھ اور سن کر اُس نے ہم پر پچاس مارک کا جرما نہ عائد کر۔ اس دوران ہم چپ چاپ کھڑے رہے۔ میرے دوست نے آفیسر سے معذرت کرتے ہوئے پچاس مارک جرمانہ ادا کیا اور اس نے ایک رسید بنا کر میرے دوست کو تھما دی۔

آفیسر نے جرمانہ وصول کرنے کے بعد شدید لہجے میں ہمیں نصیحت کرتے ہوئے کہا کہ : آئندہ جب بھی کھانا طلب کرو تو اُتنا ہی منگواؤ جتنا تم کھا سکتے ہو۔ تمہارے پیسے تمہاری ملکیت ضرور ہیں مگر وسائل معاشرے کی امانت ہیں۔ اس دنیا میں ہزاروں لوگ ایسے بھی ہیں جو غذائی کمی کا شکار ہیں۔ تمہارا کوئی حق نہیں بنتا کہ تم کھانے پینے کی اشیاء کو اس طرح ضائع کرتے پھرو۔

بے عزتی کے احساس اور شرمساری سے ہمارے چہرے سرخ ہورہے تھے۔ ہمارے پاس اُس آفیسر کی بات کو سننے اور اس سے اتفاق کرنے کے سوا کوئی چارہ بھی نہیں تھا۔ ذہنی طور پر ہر اُس بات کے قائل ہو چکے تھے جو اُس نے ہمیں کہی تھیں۔ مگر کیا کریں ہم لوگ ایسے ملک سے تعلق رکھتے ہیں جو وسائل کے معاملے میں تو خود کفیل نہیں ہے مگر ہماری عادتیں کچھ اس طرح کی بن گئی ہیں کہ ہمارے پاس کوئی مہمان آ جائے تو اپنا منہ رکھنے کیلئے یا اپنی جھوٹی عزت یا خود ساختہ اور فرسودہ روایات کی پاسداری خاطر دستر خوان پر کھانے کا ڈھیر لگا دیں گے۔ نتیجتاً بہت سا ایسا کھانا کوڑے کے ڈھیر کی نظر ہوجاتا ہے جس کے حصول کیلیئے کئی دوسرے ترس رہے ہوتے ہیں۔سچ تو یہ ہے کہ ہمیں اس بات کی اشد ضرورت ہے کہ ہم اپنی ان بری عادتوں کو تبدیل کریں اور نعمتوں کا اس طرح ضیاع اور انکا اس طرح سے کفران نا کریں۔

ریسٹورنٹ سے باہر نکل کر میرے دوست نے سامنے کی ایک دکان سے جرمانے کی رسید کی فوٹو کاپیاں بنوا کر ہم سب کو اس واقعہ کی یادگار کے طور پر دیں تاکہ ہم گھر جا کر اسے نمایاں طور پر کہیں آویزاں کریں اور ہمیشہ یاد رکھیں کہ آئندہ کبھی بھی اس طرح کا اسراف نہیں کریں گے۔

جی ہاں! آپکا مال یقیناً آپکی مِلکیت ہے مگر وسائل سارے معاشرے کیلئے ہیں۔

Islamabad—Fears are growing in Pakistan that the spread of dengue fever also known as break-bone fever may have been caused by some kind of biological experiment or deliberate release of virus by foreign elements.

Pakistan Medical Association (PMA) representatives have called on security agencies to investigate fears of deliberate spread of dengue virus in Pakistan. According to a report, the PMA members and experts have demanded in-depth investigation over mysterious spread of Dengue virus in Punjab.

Dengue fever is an infectious tropical disease caused by the dengue virus and the disease has caused alarming situation in Lahore and other Punjab cities. Lately the disease has spread to other cities of Pakistan and has killed over 100 people affecting thousands. According to experts the virus has four different types; infection with one type usually gives lifelong immunity to that type, but only short-term immunity to the others. Subsequent infection with a different type increases the risk of severe complications.

As per Internet info, in the spring and summer of 1981, Cuba experienced a severe hemorrhagic dengue fever epidemic. Between May and October 1981, the island nation had 158 dengue-related deaths with about 75,000 reported infection cases. At the height of the epidemic, over 10,000 people (per day) were found infected and 116,150 were hospitalized. At the same time during 1981 outbreak, covert biological warfare attacks on Cuba's residents and crops were believed to have been conducted against the island by CIA contractors and military airplane flyovers. Particularly harmful to the nation was a severe outbreak of swine flu that Fidel Castro attributed to the CIA. American researcher William H. Schaap, an editor of Covert Action magazine, claims the Cuba dengue outbreak was the result of CIA activities.

In 1982, the then Soviet media reported that the CIA sent operatives into Afghanistan from Pakistan to launch a dengue epidemic. The Soviets at the time claimed the operatives were posing as malaria workers, but, instead, were releasing dengue-infected mosquitoes. The CIA denied the charges. In 1985 and 1986, authorities in Nicaragua accused the CIA of creating a massive outbreak of dengue fever that infected thousands in that country. CIA officials denied any involvement, but Army researchers admitted that intensive work with arthropod vectors for offensive biological warfare objectives had been conducted at Fort Detrick in the early 1980s, having first started in the early 1950s. American Fort Detrick researchers reported that huge colonies of mosquitoes infected with not only dengue virus, but also yellow fever, were maintained at the Frederick, Maryland (U.S.), installation, as well as hordes of flies carrying cholera and anthrax and thousands of ticks filled with Colorado fever and relapsing fever.

It is significant to note that in early 2011, American CIA sponsored a fake vaccination drive in Abbottabad city of Pakistan to get DNA samples of Osama bin Laden, developing aversion to the real and much needed polio vaccination programme in Pakistan.

Bilogical attack on Afghanistan: Britain and the US have been accused of a biological attack on Afghanistan's poppy fields in an attempt to defeat the Afghani resistance, destroy wheat and fruit trees and blight the opium crop. The British daily "Telegraph" reported in May 2010 that "poppy plants (in Afghanistan) have been suffering a mysterious disease that leaves them yellow and withered and slashes the yield of opium resin, which is sold and processed into heroin. The worst-affected farmers said the scale of the infection was unprecedented. Yields have dropped by 90 per cent in some fields.

Some have claimed the British and Americans are responsible for the plague, but they strongly denied involvement. The blight was first noticed a month ago and linked to an infestation of aphids in wheat and fruit trees. It has since been found in four provinces across the south.

These biological attacks on the Afghani people brings to memory the American biological war against the Vietnamese people in the 1960s and 1970s.

Jean-Luc Lemahieu, the head of the UN Office on Drugs and Crime in Afghanistan was quoted as saying: ''We are at this moment not sure if it is a fungus or some insect. Spraying has been forbidden in very clear words by the President of Afghanistan. Hence, awaiting the results from our lab tests.''

کچھ عرصہ قبل انٹرنیٹ پر دو امریکنوں کے درمیان ایک مزاحیہ طرز کا مکالمہ کافی جگہ شائع ہوا جس میں دونوں امریکی مستقبل کی کسی وقت میں پاکستان کو دنیا کے امیر ترین روپ میں دیکھتے ہیں اور پاکستان کا ویزہ حاصل کرنے کے خواب دیکھتے ہیں۔ وہ مکالمہ کسی پاکستانی کی ہی تخلیق تھا جسے پڑھ کر میں نے بے اختیار ٹھنڈی سانس لی اور سوچا کاش حقیقت میں ایسا ہی ہو۔

لیکن آج ایک پاکستانی صاحب سے ملاقات کے بعد ان کے پر اثر دلائل سننے اور انٹرنیٹ پر چند ریسرچ رپورٹس دکھانے کے بعد مجھے ایسا لگ رہا ہے کہ اگر پاکستان چاہے تو وہ واقعی مستقبل میں دنیا کا امیر ترین ملک بن سکتا ہے۔ اس سلسلے میں سب سے بڑی رکاوٹ پاکستان کے سیاستدان اور پاکستان کا میڈیا ہے۔

سیاست دان اس لیے کہ وہ بیرونی طاقتوں کے پے رول پر پاکستان کو مسلسل تباہی اور بربادی کی طرف دھکیل رہے ہیں۔ پاکستان میں‌مصنوعی مسائل اور مصنوعی طور پر وسائل کی قلت پیدا کر کے عوام کو روٹی اور پیٹ کے چکر سے ہی باہر نہیں نکلنے دیا جا رہا۔ اور ذمہ دار کوئی ایک حکومت نہیں بلکہ گزشتہ کئی دھائیوں کی حکومتیں بیرونی طاقتوں کی اس سازش کی ایک کڑی رہی ہیں۔ اور میڈیا اس لیے کہ، وہ مسلسل غیر ضروری مسائل اور چٹ پٹے موضوعات پر پاکستان کا وقت ضائع کر رہے ہیں۔ میڈیا سے وابستہ بیشتر افراد صحیح حقائق کو جانتے ہیں مگر وہ خاموش ہو جاتے ہیں یا خاموش کرا دیے جاتے ہیں۔

سوال یہ ہے کہ پاکستان دنیا کا ایک امیر ترین ملک کیسے ہے؟ اس سوال کا جواب یہ کہ پاکستان میں‌دنیا بھر کے قدرتی وسائل اور معدنیات موجود ہیں۔ ان معدنیات میں کوئلہ، تیل، تانبا اور قدرتی گیس شامل ہیں۔ ان میں‌زیادہ تر وسائل تر بلوچستان میں ہیں۔ لیکن دیگر علاقوں پنجاب اور سندھ میں‌بھی موجود ہیں۔ ان وسائل کے متعلق جاننے کے لیے کہیں دور جانے کی ضرورت نہیں فقط گوگل سرچ ہی کافی ہے۔

پاکستان میں موجود کوئلے کے ذخائر سے بجلی بنانے کے موضوع پر ڈاکٹر ثمر مبارک کئی بار مختلف ٹی وی پروگرامز میں بات کر چکے ہیں‌مگر کوئی بھی انہیں‌وسائل مہیا کرنے کے لیے تیار نہیں ہے۔ بلکہ حکومتی عہدیدار مسلسل وسائل کی کمی کا رونا رو رو کر پاکستان کو بھکاری بنانے پر تلے ہوے ہیں۔ کبھی چین سے تو کبھی سعودی عرب سے اور کبھی امریکہ سے امداد کے لیے بھیک مانگتے نظر آتے ہیں۔
